SMS Messaging Terms & Conditions

These SMS Messaging Terms & Conditions (“Terms”) govern your participation in the Peak Utility Group (“Peak Utility,” “we,” “us,” or “our”) crew messaging program (the “Program”). By opting in to the Program, you agree to these Terms and to our SMS Messaging Privacy Policy.
1. Program description
The Program is an internal operational text-messaging service. We send SMS/MMS messages to Peak Utility Group employees, subcontractors, and crew members regarding dispatch, scheduling, job-site assignments, safety notices, and other time-sensitive operational updates. The Program is not used for consumer marketing or promotional advertising.
2. How to opt in
Participation is voluntary and consent is not a condition of employment or of any purchase. You may opt in to receive Program messages by:
- Providing your mobile number and giving verbal consent during onboarding or crew intake;
- Completing a paper or digital enrollment form that includes an unchecked consent checkbox; or
- Texting START to our messaging line at (484) 999-3954.
After you opt in, we will send a one-time confirmation message verifying your enrollment. You will not receive recurring Program messages unless you have opted in.
3. Message frequency
Message frequency varies based on operational needs. You may receive recurring messages tied to dispatch, scheduling, and safety activity.
4. Message and data rates
Message and data rates may apply. Standard rates from your wireless carrier may apply to each message you send or receive. Please contact your wireless provider for details about your messaging and data plan.
5. Getting help (HELP)
For help at any time, reply HELP to any Program message, email info@peakutilitygroup.com, or call (888) 222-1415. You can also reach our messaging line at (484) 999-3954.
6. Opting out (STOP)
You can cancel the Program at any time by replying STOP to any Program message. After you send STOP, we will send a one-time confirmation that you have been unsubscribed, and you will no longer receive Program messages. To rejoin, opt in again using any of the methods described above.
7. Supported carriers and delivery
Message delivery is subject to the effective transmission of your wireless carrier and is not guaranteed. Carriers are not liable for delayed or undelivered messages. Peak Utility Group is not responsible for any failed, delayed, or misdirected delivery of messages, or for any errors within message content.
8. Your responsibilities
You represent that the mobile number you provide is yours (or that you are authorized to enroll it) and that you will notify us if the number changes or is reassigned. You agree not to use the Program for any unlawful or abusive purpose.
9. Privacy
Information you provide in connection with the Program is handled as described in our SMS Messaging Privacy Policy. No mobile information (including your mobile phone number) is shared with third parties or affiliates for marketing or promotional purposes, and text messaging opt-in data and consent are never shared with any third parties.
10. Changes to these Terms
We may modify or cancel the Program or these Terms at any time. The “Effective” date above reflects the most recent update, and the current version will always be posted at this address. Your continued participation after changes take effect constitutes acceptance of the updated Terms.
